Comprehensive Services to Employers

Employment Litigation

We represent employers in federal and state court, as well as before administrative agencies and commissions. Our team has extensive experience in employment litigation from lawsuit inception to jury trial and beyond. We aggressively represent employers in these matters, while partnering with our clients from the outset to create a strategy for representation that fits the employer’s needs and culture. We handle employment litigation based on claims of discrimination, harassment, retaliation, wage and hour, breach of employment contract, employment torts and more. If you are an employer and have been sued for an employment related matter, our years of experience, commitment to high quality services and strong advocacy skills are essential to a successful outcome.

Workplace Investigations

Prompt and properly conducted workplace investigations are an outstanding defense to many employment-related claims. If investigations are not conducted properly, however, they create a significant risk of legal exposure. Our team is experienced in conducting workplace investigations for employers of various sizes across many industries. Investigations can be conducted in response to suspected violations of workplace rules, compliance issues, or allegations of discrimination, retaliation, and harassment. Our team also conducts compliance audits to ensure compliance with employment laws including the FLSA, OFCCP and Immigration Reform Act before legal action or government agency investigation arises.

Employment Counseling and Training

Our team works closely with employers to guide them through real-time employment related issues and disputes, develop policies, strategies, and procedures to proactively prevent employment disputes, charges and lawsuits from arising. We assist employers in drafting employee handbooks and policies that comply with all local, state, and federal laws. We also provide training to human resources, management, supervisors, and employees on an array of topics focused on compliance with current law and the employer’s policies. We provide employers comprehensive advice and counsel on implementing policies as well as everyday matters such as hiring, discipline, termination, and employee complaints of discrimination or harassment.

Representative Cases

Fair Labor Standards Act

A large PEO (Professional Employer Organization) was alleged to be a joint employer under the Fair Labor Standards Act. We were retained by the VP of Human Resources to defend the PEO in a case that would have existential impact. We were able to obtain a final summary judgement in favor of the organization.

Enforced Client’s Non-Compete Agreement

A Principal of a Medical Practice Group retained us for general legal matters. When a former physician left the group and formed a new practice, we were able to successfully enforce an existing non-compete agreement resulting in a seven-figure settlement to our client.

Supplement In-House Counsel

A large banking institution contacted us when sued by a former branch manager. The case alleged both age and sex discrimination. The case was handed over by in-house counsel. We  successfully defended the bank resulting in a favorable defense verdict.

Whistle Blower Case

An aviation manufacturer in central Florida was sued for alleged whistleblower retaliation under Florida law. We were retained by the President of the company to represent them in defense of the lawsuit filed by a former line worker. After some discovery, we were able to obtain final summary judgement resolving the case in favor of the company.

Government Services

We were retained by the co-owner of a company providing contract services to the federal government. The company has had a reputation as a great place to work and had never been sued by any of its hundreds of employees. The company’s entire executive team was shocked when sued by an employee for hostile work environment sexual harassment and retaliation. Through working closely with the relevant employees and executive team, we were able to establish that there was no hostile work environment harassment as a matter of law obtaining summary final judgment in favor of the employer.

Retail Team Management

We were retained by in house counsel of a large regional grocery store chain when they were sued by a current employee for age discrimination and retaliation. We were able to establish that the decisions made concerning the employee were not related to his age and were based on legitimate non-discriminatory reasons, obtaining final summary judgment in favor of the employer.
